Terms of Purchase, Waiver, and Guest Agreement

1. Introduction and Acceptance of Terms

Welcome to Old Fashioned Magic, presented by Cocktails and Card Tricks LLC (“we,” “us,” or “our”). By purchasing tickets, completing your order, or attending the Old Fashioned Magic experience, you (“you” or “guest”) agree to be bound by these Terms of Purchase, Waiver, and Guest Agreement. Please read them carefully before completing your purchase.

These terms constitute a legally binding agreement between you and Cocktails and Card Tricks LLC. If you do not agree to these terms, do not complete your purchase or attend the event.

2. Ticket Purchase and Pricing

All ticket prices are listed in U.S. dollars. The price displayed represents the per-ticket admission cost. Additional service fees may apply per ticket or per order and will be clearly displayed prior to completion of your purchase. You will have the opportunity to review the total cost, including all applicable fees, before confirming your order.

By completing your purchase, you confirm that you have reviewed and accepted the total amount charged, including any service fees displayed during checkout.

3. Payment Processing and Security

All payment processing is handled by Stripe, a PCI DSS Level 1 certified payment processor. Your payment information, including credit card numbers and billing details, is collected and processed directly by Stripe and is never stored on our servers. We receive only a transaction confirmation, a transaction ID, and basic card summary information such as the last four digits and card brand.

By completing your purchase, you authorize us to charge the payment method you provide for the total amount displayed at checkout. All sales are final at the time of purchase confirmation.

4. Order Confirmation and Ticket Delivery

Upon successful completion of your purchase, you will receive an order confirmation via the confirmation page displayed in your browser and by email to the address you provided. Your ticket(s) will be delivered electronically via email and/or SMS. Please ensure your email address and phone number are entered correctly at the time of purchase.

If you do not receive your confirmation or tickets within a reasonable time, please contact us before the event. We are not responsible for losses arising from your failure to receive confirmation due to an incorrect email address, spam filtering, or other issues outside our control.

You are responsible for safeguarding your tickets. Duplicate or fraudulent tickets will not be honored. We reserve the right to require valid photo identification matching the name on the order at the time of entry.

5. Ticket Limits and Access Restrictions

To ensure fairness and availability, we may impose ticket limits per transaction or per customer. These limits vary by ticket type and are subject to change. Orders that exceed posted ticket limits, including multiple orders placed using the same name, email address, billing information, or payment method, may be canceled at our discretion.

We reserve the right to deny access to our ticketing platform and to cancel orders placed in violation of these limits without notice or refund in the case of deliberate circumvention.

6. Refund and Exchange Policy

All ticket purchases are final and non-refundable. Tickets may not be exchanged for a different date, time, or ticket type. It is your sole responsibility to verify that the date, time, location, and ticket type are correct before completing your purchase.

Exceptions to this policy apply only in the event of a canceled or rescheduled performance, as described in Section 7 below. We do not offer refunds for personal scheduling conflicts, changes in plans, or failure to attend.

7. Canceled or Rescheduled Performances

In the event that a scheduled performance is canceled or rescheduled, we will make reasonable efforts to notify ticket holders using the contact information provided at the time of purchase. Notification may be provided by email, SMS, or through our website.

In the event of a cancellation, we will provide ticket holders with options that may include a refund to the original payment method, a credit toward a future performance, or exchange for an available date. The specific options available will be communicated at the time of cancellation.

We are not liable for any costs incurred by guests in connection with a canceled or rescheduled performance, including but not limited to travel, lodging, or other related expenses.

8. Admission, Conduct, and Use of Ticket

Your ticket constitutes a revocable license to attend the specific performance indicated. We and venue management reserve the right to refuse admission or remove any guest from the premises without refund if, in our sole judgment, that guest engages in any of the following:

9. Late Arrival Policy

Latecomers will be seated at the discretion of venue management and only at appropriate breaks in the performance. Due to the nature of the experience, late entry may not be possible during certain portions of the show.

Guests holding premier or priority seating who arrive after their designated seating window may be relocated to available general seating without reimbursement or refund. Seating assignments are subject to change at the discretion of venue management.

10. Recording, Photography, and Intellectual Property

The Old Fashioned Magic experience, including all performances, illusions, effects, routines, and presentation elements, constitutes proprietary intellectual property. To protect the experience for all guests and preserve the integrity of the performance, the following restrictions apply:

11. Photo and Media Release

By attending Old Fashioned Magic, you grant Cocktails and Card Tricks LLC, its affiliates, and the host venue permission to photograph, film, or otherwise record your image, voice, and likeness during the event. You agree that such recordings may be used worldwide, without compensation to you, for promotional, advertising, marketing, and archival purposes related to the Old Fashioned Magic experience, including use on websites, social media, print materials, and other media.

If you do not wish to be photographed or recorded, please notify a staff member upon arrival and we will make reasonable accommodations where possible.

12. Release of Liability and Indemnification

By attending Old Fashioned Magic, you acknowledge that attendance at a live performance involves inherent risks. To the fullest extent permitted by applicable law, you voluntarily release and discharge Ryan Plunkett, Cocktails and Card Tricks LLC, Fifthwall LLC, the host venue, Davidson Hospitality Group, The Alexander, and each of their respective officers, employees, agents, contractors, and affiliated parties (collectively, “Released Parties”) from any and all claims, demands, damages, losses, liabilities, costs, and expenses arising from or related to:

You further agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from your actions, conduct, or violation of these terms during the event.

Nothing in this section limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

13. Personal Information and Privacy

We collect personal information in connection with your ticket purchase, including your name, email address, phone number, and billing zip code. Your payment information is processed by Stripe and is not stored on our systems. Please review our Privacy Policy for a complete description of how we collect, use, and protect your personal information.

By completing your purchase, you consent to receiving transactional communications related to your order, including order confirmations, ticket delivery, and event reminders. These communications are necessary to fulfill your purchase and cannot be opted out of.

14. Accessibility

We are committed to providing an accessible experience for all guests. If you require accessibility accommodations, please contact us prior to your visit so that we can make appropriate arrangements. Accommodation requests made at the door may be subject to availability.

15. Modifications to These Terms

We reserve the right to update or modify these terms at any time. The version of these terms in effect at the time of your purchase governs your attendance. We encourage you to review these terms prior to each purchase.

16. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising under these terms shall be resolved exclusively in the state or federal courts located in Franklin County, Ohio and you consent to the personal jurisdiction of such courts.

To the extent permitted by law, any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
